What is a Law Costs Draftsman?

Law Cost Draftsmen are responsible for dealing with all aspects of solicitors’ costs that are controlled by both statute and common law. They deal with every conceivable type of legal matter that touches upon the subject of costs and it is the Costs Draftsman’s skill to successfully assist in the legal process.
The role is to primarily undertake all legal costing services for our Solicitor clients to include the preparation of Bills of Costs, Points of Dispute and Points of Reply, negotiate settlements on cost matters, appear as an Advocate at cost related hearings, undertake administrative work related to the recovery of costs, prepare costs budgets, undertake costs management work during the course of litigation and advise clients as to costs issues.

Main duties and responsibilities

In order to become familiar with office procedure your training will cover both administrative roles and responsibilities as well as cost drafting training within the office.

Outcomes

  • Trained Costs Draftsman, competent in both Legal Aid and Inter Partes matters

Administrative (year 1 onwards)

  • Document management – filing, scanning, faxing, e-mailing
  • Preparing copy bundles
  • Identifying missing documents from files
  • Sort through incoming post and DX
  • Logging incoming files on database
  • Assist with outgoing post and DX
  • Handling telephone system
  • Assisting the team where required
  • Assist with implementing new internal office procedures
  • Assisting with monitoring accounts and credit control
  • Preparing invoices and inputting data on to Sage programme
  • Assisting with the collation and preparation of weekly and monthly office reports
  • Undertaking marketing research and assisting with the implementation of the marketing plan
  • Maintaining marketing records

Cost drafting

Legal Aid (year 1 onwards)

  • Undertaking internal training programme
  • Accessing relevant resources
  • Developing small caseload including LAA forms, bills of costs and post assessment work, subject to close supervision and one-on-one training
  • Undertaking legal research
  • Maintaining professional development
  • Liaising with clients, subject to close supervision
  • Undertaking regular reviews to monitor progress

Inter Partes (year 2 onwards)

  • Undertaking internal training programme
  • Accessing relevant resources
  • Developing a varied caseload including bills of costs, schedules of costs, replies and/or points of dispute, negotiations, preparing pleadings, costs budgets and costs management work, solicitor and own client bills, litigant in person matters and preparing advices subject to close supervision and one-on-one training
  • Undertaking legal research
  • Maintaining professional development
  • Liasing with clients, subject to close supervision
  • Undertaking regular reviews to monitor progress
  • Complete company training day
  • Complete end of inter partes training exam

General

  • Observe company policy and procedure at all times
  • Ensure data protection is maintained at all times
  • Complete all training and work associated with it within the specified timescales
  • Observe health and safety practices in the office
  • Developing a professional relationship with your designated trainer
  • Demonstrate initiative, working well as a member of the team  and as an individual
  • Maintain professional courtesy at all times to colleagues and clients
  • Undertake any other work that may be required of you by the company
